The cottage is located on state owned, leasehold land which is managed by the Shire of Denmark. The current 21yr lease commenced in July 2010, with rental set at $1100pa. Permitted use is for Holiday Cottage unless otherwise negotiated with the Shire of Denmark.

Development of all leasehold property is guided by the Peaceful Bay Conservation Plan Development Guidelines, though perhaps less stringently for Fifth Avenue since it sits outside the northern edge of the Peaceful Bay Heritage Precinct.
